According to Vanguard News, Peter Obi, a candidate of the Labour Party (LP), concluded his case in the presidential election petition, where he accused President Bola Tinubu of the All Progressives Congress (APC) of rigging the February 25th election. Obi presented numerous pieces of documentary evidence and called 13 witnesses before the Presidential Election Petition Court (PEPC) in Abuja.

During the proceedings, Obi submitted polling unit results from all 36 states and the Federal Capital Territory (FCT), along with documents indicating the total number of collected Permanent Voters Cards (PVCs) in 32 states before the 2023 general elections. He also tendered video exhibits, including a press conference where the Chairman of the Independent National Electoral Commission (INEC) assured the public of real-time electronic transmission of results using the Bimodal Voter Accreditation System (BVAS) machines.

Additionally, Obi and the LP presented documents containing the total number of registered voters in each state. The court admitted certified true copies of INEC Forms EC40Gs, EC40G1, and EC40GPU, which were reports of polling units where elections did not take place.

While the Respondents objected to the admissibility of the evidence, they reserved their reasons for objection for their final written addresses.

Although the Petitioners initially intended to call 50 witnesses, they closed their case after the testimony of the 13th witness. One of the witnesses, Tanko Yunusa, who served as the Chief Spokesman of the Labour Party Presidential Election Council, testified about the LP’s dissatisfaction with the election outcome.

Yunusa, when cross-examined, stated that he did not provide specific figures for the number of unlawful votes credited to Tinubu and the APC. He also mentioned that the LP filed several suits before the general elections and presented a judgment of the Federal High Court in Abuja, which refused the reliefs sought by the party regarding electronic transmission of election results.

The LP’s wish was to void the entire election results, including those allocated to their candidate, Peter Obi. Yunusa highlighted that the LP deployed a significant number of agents to monitor the elections across the country.

After Yunusa’s testimony, the Petitioners called their 13th witness, Peter Emmanuel Yari, who served as a Presiding Officer in Kaduna State during the presidential election. Yari encountered challenges with the accreditation of voters and the uploading of results using BVAS machines.

Following Yari’s testimony, the Petitioners’ lead counsel announced the closure of their case. The court then scheduled July 3rd as the date for INEC to present its defense in response to the petition.

The respondents in the case include INEC, President Bola Tinubu, Vice President Kashim Shettima, and the APC. The LP candidate, Peter Obi, filed the petition challenging Tinubu’s declaration as the winner of the presidential contest. The petitioners argued that Tinubu was not qualified to participate in the election and cited allegations of previous indictments and fines against him.

The Petitioners sought various reliefs, including the cancellation of the election and the conduct of a fresh election in which Tinubu, Shettima, and the APC would not participate. They also requested a declaration that the election was void due to non-compliance with the Electoral Act and the Constitution.
